Terms of Use

The present document titled “Terms of Use” constitutes a legally binding agreement for the provision of tourist services between the sole proprietorship of Emmanouil Vasileiadis, son of Drosos, resident of Heraklion, 19 Salaminos Street, VAT No. 070954937 (hereinafter referred to as the “Business”), and the customer/passenger (hereinafter referred to as the “Passenger”). Acceptance of these Terms is a mandatory prerequisite for participation in the cruise, and the Passenger declares that they have carefully read this document, fully understood it, thereby accepting its entire content.

1. Legal Framework

The services provided are governed by Law 4926/2022 on tourist vessels, the Greek Public Maritime Law Code, Law 2251/1994 on consumer protection, Regulation (EU) 2016/679 (GDPR), and all relevant Greek and European Union legislation.

2. Subject of the Agreement

The Business organizes and operates daily tourist cruises with/without overnight stay using a professional sailing vessel, for the purpose of leisure and sea excursions of the Passenger.

3. Bookings – Payments

The booking is confirmed upon payment of a deposit equal to fifty percent (50%) of the total cruise fare. The remaining balance must be paid five (5) days prior to the cruise departure date. The booking is completed upon payment of the agreed price. The price includes exclusively the services expressly stated in the offer (cruise, meal, activities).

4. Cancellations – Modifications

By the Passenger:
– Cancellations made five (5) or more days prior to departure: Full refund minus a cancellation fee of ten (10) euros.
– Cancellations made from five (5) to two (2) days prior to departure: Fifty percent (50%) of the total fare is refunded.
– Cancellations made less than two (2) days prior to departure: No refund is granted.
The Passenger should notify the Business for the cancellation in writing.

Changes to the booking requested by the Passenger (dates, passenger details, etc.) are subject to availability, and may incur additional charges.
Refunds will be processed within two (2) business days from the date of cancellation. and will be made using the original method of payment.

By the Business:

The Business reserves the right to cancel the cruise/activity up to two (2) days prior to the cruise/activity, in which case a full refund will be issued within two (2) business days using the original method of payment. However, for safety reasons, weather conditions, force majeure, or upon instruction by the authorities, the Business has the right to cancel the cruise/activity at any time point prior to the cruise/activity, in which case the full amount paid will be refunded using the original method of payment without any further claim.

5. Minor Passengers

The participation of minors is permitted only under the continuous accompaniment and supervision of an adult parent or legal guardian. The accompanying adult bears full civil and criminal liability for the minor’s conduct, compliance, and safety.

6. Meal & Activities

During the cruise, a meal is provided, as well as the option for swimming and the use of a SUP. Participation in these activities is at the sole responsibility of the Passenger, who declares that they know how to swim and possess the necessary physical condition.

7. Health – Declarations

The Passenger declares that they do not suffer from any medical condition or physical state that would render participation in the cruise unsafe, and is obliged to inform the Business, the Captain, and/or the crew of any allergies or serious medical issues.

8. Conduct – Safety

Passengers are required to comply with the instructions of the Captain and the crew. Passengers are expected to observe all safety regulations and instructions provided before and during navigation. The Business reserves the right to refuse the provision of services to any Passenger who violates instructions and regulations or displays inappropriate behavior (e.g. excessive alcohol consumption, harassment). The Business may disembark a Passenger who violates the Terms, without any refund.

9. Liability

The Business shall be liable only for damages caused by willful misconduct or gross negligence, in accordance with the law. It bears no liability for loss of personal belongings. The Business shall bear no liability whatsoever for any damage, whether direct or indirect, resulting from the Passenger’s culpable refusal or inability to comply with the obligations set out in Article 8.

10. Insurance

The vessel carries the mandatory civil liability insurance as required by law.

11. Weather – Maritime Risk (Assumption of Risk Clause)

The Passenger acknowledges that sea transportation is subject to changing weather and maritime conditions. The Passenger accepts that rough seas, winds, changes of route, schedule, or stopping points may occur. Participation takes place with full knowledge and assumption of the inherent maritime risk. The Business and the Captain retain absolute discretion to modify or terminate the cruise for safety reasons, without any liability or compensation beyond the refund of paid amounts, should such a decision be made.

12. Personal Data

Personal data are processed exclusively for the performance of the contract and for compliance with legal obligations. The protection of your personal data is of utmost importance to the Business. We are committed to safeguarding your privacy and fully complying with the General Data Protection Regulation (GDPR) and applicable Greek legislation.

a. Data Controller:

b. Collection and Processing of Personal Data:
We collect and process personal data voluntarily provided by you when you contact us or make a booking through our website. This may include: Full name, nationality, age, passport or ID number, email address, phone number, payment details (e.g. credit card information), preferences regarding our cruises.

c. Purpose of Processing:
Your personal data are used for: Processing bookings and providing our services; Communicating with you regarding bookings or inquiries; Improving our services based on your preferences; Compliance with legal obligations (passenger lists, charter agreements, issuance of receipts or invoices)

d. Legal Basis for Processing:
Processing is based on: Performance of a contract; Legal obligation; Legitimate interests, including service improvement and communication.

e. Disclosure to Third Parties:
We do not share personal data with third parties unless necessary for contract performance (e.g. service providers) or required by law. In all cases, we ensure that third parties comply with data protection standards.

f. Data Security:
We implement all appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or destruction. However, data transmission over the Internet is not entirely secure, and absolute security cannot be guaranteed.

g. Data Subject Rights: 

According to the GDPR, you have the following rights:

Right of access: To know what data we process about you and for what purpose.

Right to rectification: To request the correction of inaccurate or incomplete data.

Right to erasure: To request the deletion of your data under certain conditions.

Right to restriction of processing: To request the restriction of the processing of your data.

Right to data portability: To receive your data in a structured, commonly used, and machine-readable format.

Right to object: To object to the processing of your data for specific purposes.

h. Data Retention Period:
Personal data are retained only for as long as necessary to fulfill the purposes for which they were collected or as required by law, after which they are securely deleted.

13. Governing Law – Jurisdiction

Any matter relating to the interpretation and application of these Terms shall be governed by Greek law, and shall fall under the exclusive jurisdiction of the competent courts of Heraklion, Crete.

14. Changes to the Terms

The Business reserves the right to amend these Terms of Use at any time. Any changes will be published on our website, and shall enter into force upon publication. Passengers are encouraged to regularly review the page for updates.
